Terms of Service
These Terms of Service (the “Terms”) govern your access to and use of the JVScope website at jvscope.com and the JVScope application and related services (collectively, the “Service”). By accessing or using the Service, or by connecting a third-party platform account to the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
JVScope is a precision retention-intelligence platform for short-form social video. It ingests videos and their associated platform performance metrics and analyzes them against a proprietary retention framework to produce pre-publish scoring (“Forecast”), post-publish analysis (“Field”), and live performance alerting (“Signal”). JVScope is an analytics tool. It reads data with your authorization; it does not post, publish, upload, edit, or delete content on any connected account.
2. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Service. The Service is intended for professional and business use by creators, brands, and their representatives — it is not intended for personal or consumer use. By using the Service you represent that you meet these requirements and that any information you provide is accurate.
3. Access and account security
Access to the JVScope application is restricted and may require a password or other credentials that we issue to you. You are responsible for keeping your credentials confidential and for all activity that occurs under them. You must notify us promptly at michael@journeyviral.com of any unauthorized use. We may suspend or revoke access at any time to protect the Service or comply with the terms of a connected platform.
4. Connecting a platform account
The Service lets you connect a third-party social-media account (for example, a TikTok account) through that platform's official authorization flow. By connecting an account you represent and warrant that you own it or are expressly authorized by its owner to connect it and to permit JVScope to access the data described in our Privacy Policy. You grant us permission to access and process that data solely to provide the Service to you. You may disconnect an account or revoke that authorization at any time — through the connected platform's settings or by contacting us — after which we stop accessing new data from that account.
5. Third-party platforms and services
The Service interoperates with third-party platforms (including TikTok) and relies on third-party service providers (including AI and infrastructure providers). Your use of a connected platform remains governed by that platform's own terms and policies, and you are responsible for complying with them. We access platform data only in accordance with the platform's developer terms and the scopes you authorize. We are not responsible for the acts, omissions, availability, or policy changes of any third-party platform or provider, and a platform may change or discontinue its API in ways that affect the Service.
6. Acceptable use
You agree not to: (a) use the Service in violation of any law or of any connected platform's terms; (b) attempt to access data belonging to accounts you do not own or are not authorized to manage; (c) reverse engineer, scrape, resell, or create derivative services from the Service or its outputs except as permitted in writing; (d) interfere with or disrupt the Service, or attempt to bypass its security or access controls; or (e) use the Service to build a competing product.
7. Intellectual property
The Service, including the JVScope retention framework, software, scoring methodology, and all related content, is owned by Viral Secrets LLC and protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable right to use the Service for your internal business purposes during the term of your access. Data you or your connected accounts supply remains yours; you grant us the license needed to process it to provide the Service. Analyses and scores we generate are provided for your use, subject to these Terms.
8. No performance guarantee
JVScope provides analytical estimates and guidance based on historical data and a proprietary framework. It does not guarantee any particular reach, view count, engagement, virality, or business outcome. You are solely responsible for decisions you make based on the Service's outputs.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Viral Secrets LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE THREE MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100).
11. Indemnification
You agree to indemnify and hold harmless Viral Secrets LLC and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, your violation of any connected platform's terms, or your connection of an account you were not authorized to connect.
12. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required to comply with a connected platform's terms, or to protect the Service. On termination, your right to use the Service ends; sections that by their nature should survive (including ownership, disclaimers, limitation of liability, and indemnification) will survive. We handle any associated data as described in the Privacy Policy.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the effective date above and post the updated Terms on this page. Material changes take effect when posted; your continued use of the Service after that constitutes acceptance.
14. Governing law
These Terms are governed by the laws of the United States and of the state in which Viral Secrets LLC is organized, without regard to conflict-of-laws principles. The exclusive venue for disputes will be the courts located in that jurisdiction, and you consent to their jurisdiction.
